These Terms, along with your Confirmation Emails, any pre-contractual information, and individual or packaged product booking and use terms and policies, including those of the third party suppliers communicated, set out the legal terms on which Travel Services are made available to you.

IMPORTANT: You must not make any booking or use our Platform unless you understand and agree with these Terms (whether you book on the Platform, in person, over the phone or by email).

We will rely on the authority of the person making the booking to act on behalf of any other traveller on the booking (regardless of whether other travellers have made separate payments) and that person will bind all such travellers to these Terms.

Voyasure owns and operates the Platform. We may list Travel Services offered by third-party Travel Providers and may from time to time package such offerings from multiple providers. While we exercise care in selecting reputable Travel Providers, we are not ourselves a provider of the underlying Travel Services and have no control over, or liability for, the products or services provided by third parties. You will also be subject to the terms and conditions of the applicable Travel Providers in addition to these Terms.

1. Definitions

"Voyasure," "we," "us," "our" – Voyasure Pty Ltd (ABN 688 128 341), a Queensland-based proprietary company registered with ASIC.

"You," "your," "customer," "passenger," "guest," "purchaser" – the person acquiring or using our Service.

"Travel Provider" or "Travel Supplier" or “Travel Experience Provider” – the third-party supplier making available the Travel Services through our Platform.

"Travel Services" or "Travel Offer" or “Travel Experience”  – travel services made available by Travel Providers through our Platform, including accommodation, flights, experiences, activities, and other travel products. These terms may be used interchangeably throughout these Terms.

"Platform" or "Service" – our websites, apps and online tools.

"Content" – descriptions, texts, reviews, images, videos, or other content on our Service.

"Booking", “Reservation” – a reservation for Travel Services made through our Platform.

“Confirmation Email” – the confirmation email we send you after your order is received or accepted depending on the Travel Experience you book.

"Supplier Terms" – the terms and conditions, including policies and restrictions of Travel Suppliers (such as an airline/cruise line’s conditions of carriage, a property's terms and conditions, a car rental company's rental agreement, etc.) that apply to your booking.

2. About These Terms

When booking with us, you accept these Terms, Supplier Terms and other applicable policies and restrictions. 

Entire agreement

These Terms, together with your Confirmation Email, any pre-contractual information, and the applicable Supplier Terms, constitute the entire agreement.

Amendment

We may amend these Terms by posting updated Terms with a new "Last Revised" date. Continued use of our Platform after changes take effect constitutes your acceptance of the updated Terms. Any changes will not affect existing bookings.

Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions will continue in full force and effect.

No waiver

Our failure or delay in enforcing any provision of these Terms will not constitute a waiver of our rights to enforce that or any other provision later.

Assignment

We may assign, subcontract, or delegate our rights, duties, or obligations under these Terms. You may not assign, transfer, or delegate any of your rights or obligations without our prior written consent. We will not assign or delegate in a way that reduces any rights or guarantees you have under these Terms.

Electronic communications

You consent to receive all communications, notices, and documents electronically.

Language

The English version of these Terms is the original. In the event of any dispute regarding these Terms, or any inconsistency between the English version and a version in another language, the English version shall prevail.

Governing law

These Terms are governed by the laws of Queensland, Australia. You agree to submit to the exclusive jurisdiction of the courts of Queensland in respect of any dispute arising out of or relating to your use of our Platform.

3. How It Works 

We provide and operate the Platform on which Travel Offers are listed, individually and in bundle from Travel Suppliers and you can search for, compare and book them. We don't necessarily display all offers by those Suppliers and there might be other Suppliers or same Suppliers offering similar or the same Travel Offers under different terms elsewhere. 

We offer a personalized experience based on how you use our Platform (including what you tell us) so you can book your ideal Travel Experience with us.

When you find and book a Travel Experience such as accommodation, flight, cruise or other leisure activities, we provide and are responsible for the Platform itself, not the underlying Travel Experience. In this regard, you enter into a direct contract with the Travel Supplier. We are not a party to that contract. The Travel Supplier is responsible for providing the Travel Services under the Supplier Terms.

Once you have accepted the applicable policies and completed your booking, we confirm the details of your booking to both you and the Travel Supplier, including traveller names and other relevant information you provide. Depending on the terms of your booking, some bookings may not be cancellable, while others may only be cancelled free of charge before a specified deadline.

As the person making the booking, you are responsible for the actions and conduct of all travellers included in the booking in relation to the Travel Experience. You are also responsible for obtaining their consent before providing us with their personal data.

We rely on the authority of the person making the booking to act on behalf of all other travellers included in the booking (regardless of whether those travellers make separate payments). That person will bind all travellers to these Terms.

4. Supplier Terms 

In addition to these Terms, your booking is also subject to any applicable policies, terms, and conditions of the relevant Travel Suppliers (such as an airline’s or cruise line’s conditions of carriage, a property’s terms and conditions, or a car rental company’s rental agreement) (collectively, the “Supplier Terms”).

By making a booking, you agree to and accept the Supplier Terms of each Travel Supplier providing one or more components of the Travel Services (such as payment obligations, cancellation policies, refundability, availability restrictions, and rules on the use of fares or services). Such terms may be provided before, together with, or after your booking, or made available directly by the Travel Suppliers at any time or upon reasonable request.

It is your responsibility to obtain, read, and comply with all applicable Supplier Terms. Any violation of the Supplier Terms may result in the cancellation of your booking, denial of access to the Travel Services, and forfeiture of any amounts paid, in accordance with the relevant Supplier Terms.

These Terms and any other information displayed on our Platform will prevail only to the extent of any inconsistency with the Supplier Terms of the underlying Suppliers or with applicable law.

5. Our Platform and Using Our Service

We own and operate our Platform and the Travel Suppliers provide the Travel Services to you. This service is provided to you for no other purpose. By making a booking, you and each person in the booking acknowledge that we are not ourselves a provider of these services, we have no direct control over, or liability for, the services provided by these third parties. 

We do not, to the extent permitted by law, make guarantees regarding the availability or continued offering of any specific Travel Services. All Travel Services are subject to availability from Suppliers and may be withdrawn at any time. 

There are many Travel Offers available through our Service, and we aim to make your search results as relevant as possible. On the search results page, you will see our default sort order, but you can choose how to sort your results and use filter options to prioritise them based on your preferences — for example, by price or other criteria.

The inclusion of any Travel Supplier or Travel Service on our Platform does not constitute a recommendation, endorsement, or guarantee of that Supplier or its products, services, facilities, offers, or representations.

Travel Suppliers provide us with information describing their Travel Services, including details such as descriptions, photos, rates, applicable policies, and restrictions. We display this information on our Platform as provided to us. We can’t verify or guarantee that everything is accurate, complete or up to date (the suppliers are responsible for ensuring that) but when providing our Platform, we take reasonable care and act with professional diligence to correct/fix them as soon as we become aware.

We shall not be liable for any inaccuracies, omissions, or incomplete information provided by Travel Suppliers (including ratings, which are offered for general guidance only and may not always reflect official ratings), except to the extent such inaccuracies result directly from our negligence or wilful misconduct.

We will show you the offers available to you in (what we think is) the right language or currency for you or your location. You may change the language or currency at any time.

We may, at our discretion, deny access to our Service to any person at any time for any legitimate reason. We may also modify, suspend, or discontinue any part of our Service at any time.

To make a booking, you must be at least 18 years of age. You may need to create an Account, or we may create one for you upon your booking request. Please ensure that all information you provide (including payment and contact details) is your own, accurate, and up to date. Failure to do so may result in your inability to access or complete your Travel Experience(s).
You are responsible for maintaining the confidentiality of your login credentials and for all activity conducted under your Account, including any transactions you did not intend to perform. If you become aware of any unauthorized use of your Account, you must notify us immediately and provide any reasonably requested information.

You agree that:

  • You will use our Service for personal, non-commercial purposes only
  • You are at least 18 years of age and have the legal capacity to enter binding contracts
  • You will use our Service in compliance with these Terms and all applicable laws
  • You have read, understood and agree to be bound by these Terms, the Supplier Terms and any other policies and restrictions that apply to your booking
  • All information you provide is accurate, current, and complete
  • When booking on behalf of other travellers:
    • You have their authorization to act on their behalf
    • You have informed them of these Terms and the applicable Supplier Terms, and they have agreed to comply
    • You are responsible for all payments and all matters concerning the booking

You must not:

  • Make any false, fraudulent, or speculative booking
  • Use any automated or manual means (including robots, spiders, or scrapers) to access, monitor, or copy content from our Service.
  • Circumvent or attempt to circumvent any technical measures we use to control access to our Service.
  • Deep link to any part of our Service without prior express authorization
  • Frame, mirror, or embed any part of our Service in another website
  • Use our Service in any way that is not reasonable or that disrupts, interferes with, or damages it

6. Confirmation Email 

When you make a booking, we communicate your request or order to the relevant Travel Suppliers where applicable and notify you of the outcome once we receive their instructions. We or the Travel Suppliers may reject or place your booking request on hold for any reason, including (but not limited to) compliance checks (such as sanctions restrictions applicable to certain individuals or countries), price discrepancies, inaccurate information provided, or unavailability or inability to perform the Travel Services.

We will send your Confirmation Email, along with any relevant travel documents or notifications, to the email address you provide at the time of booking. If you do not receive your Confirmation Email within 24 hours of making your booking, please contact us.

Your Confirmation Email will include the essential details of your booking, such as a description of the Travel Service(s) booked, instructions and any further action required by the Travel Suppliers. Depending on the Travel Services requested, the Confirmation Email may confirm our receipt of your booking request, but not necessarily its acceptance or guarantee by the Travel Supplier.

Please review your Confirmation Email immediately and carefully upon receipt. Notify us within 24 hours if you identify any errors or inconsistencies. Ensure that all traveller names match their travel documents exactly.

7. Prices, Charges and Payment

Displayed or quoted prices

When you make a booking request, you agree to pay the cost of the Travel Experience, including any charges and taxes that may apply. The prices for Travel Services will be as shown on our Service, except in cases of an obvious error. 

Prices are dynamic and may change at any time. We list numerous Travel Offers from multiple Suppliers and take reasonable care to ensure that all displayed prices are accurate. However, obvious errors or misprints are not binding, and we reserve the right to correct any pricing errors. We are not obligated to honour an incorrect (lower) price, even after a Confirmation Email has been issued, if the pricing error was or should have been reasonably apparent.

If an obvious pricing error is identified after you have made a booking, we reserve the right to give you the option to either: (a) keep your booking at the correct price, or (b) cancel your booking and get back anything you have paid. 

Taxes and Fees

The displayed prices may or may not include taxes, fees, and charges, as indicated on our Service. Such taxes and charges may include, among others, value-added tax (VAT), goods and services tax (GST), sales tax, occupancy tax, or other similar taxes.

Some taxes or fees may be payable directly to the Travel Suppliers or local authorities. You may also be responsible for dealing with any retroactive change in the tax rate (for example, if taxes have changed by your experience start date).

In certain jurisdictions, you may be required to pay local taxes imposed by local tax authorities (which may be referred to differently, for example, as a “city tax,” “tourist tax,” “green tax,” “environmental levy,” or “climate resilience tax”). 

Where such taxes or fees have been disclosed to us by the Travel Supplier, we will notify you of them before you complete your booking.

Additional costs

You may incur additional costs not included in your booking price (such as optional extras, baggage fees, meals, seat selection, change fees, cancellation charges, no-show penalties, damage charges, or other incidentals). These are your responsibility and are handled between you and the Travel Supplier.

Currency, Conversion and Issuer Fees

Some banks and card issuers may impose fees for international, cross-border or foreign currency transactions. For example, if you make a booking using a card issued in a different country, or if your account currency differs from the local currency of our Service, your card issuer may charge additional fees. These may be referred to differently depending on your country or financial institution.

Many banks and card issuers also apply foreign currency conversion fees and may use exchange rates that are not favourable to you. If you have any questions regarding these fees or the exchange rate applied to your booking, please reach out to your bank or card issuer directly.

We are not affiliated with, and bear no responsibility for, any such fees, charges, or exchange rate differences applied by banks or card issuers.

Payment 

We may accept various secure payment methods for different Travel Services listed on our Platform. Regardless of the payment method you choose, we comply with the stringent requirements of the Payment Card Industry Data Security Standard (PCI DSS). We never have access to, nor do we store, your full payment details such as credit card numbers. The payment service provider that processes your payment will notify us once your payment has been successfully received.

We may also work with third-party providers of alternative payment methods to offer you additional payment options. We do not endorse or recommend any alternative payment provider, their products, or their services, and we are not responsible for the content, acts, or omissions of such providers. Your use of any alternative payment method is at your own risk and is governed by that provider’s terms and policies.

Some Travel Services require upfront payment, while others may require payment at the time of travel, as determined by the relevant Travel Provider. The applicable payment timing may depend on the specific Travel Provider or the type of Travel Experience.

If we organize or process your payment (which is the most common scenario, where you pay directly on our Platform), we will manage the transaction and ensure the completion of your payment to the Travel Provider for the applicable Travel Offer(s). In this case, your payment to us satisfies your upfront “due and payable” payment obligation to the Travel Provider.

If the Travel Provider processes the payment directly—whether as an option you choose or because it is the only option available—payment is typically charged at the start of your Travel Experience but may also occur at the time of booking or later (for example, upon arrival or check-out), depending on the Travel Provider’s payment policy disclosed at the time of booking. Accordingly, if for any reason the charge is not made to your payment method at the time of booking, it may still occur thereafter.

Please note that your payment may be subject to Currency, Conversion, and Issuer Fees as described above, regardless of who processes the payment.

For certain Travel Experiences, payment may be processed by more than one party, however, the total amount charged will not exceed the total price of all the Travel Experiences booked.

Some Travel Providers may require advance payment, deposits, pre-authorizations, or payment holds at the time of booking. Where we do not organize or process your upfront payment at checkout, we do not control the Travel Provider’s payment policies. These arrangements are between you and the Travel Provider and may be non-refundable. You should review the Travel Provider’s payment policy before completing your booking. 

Payment Authorization and Verification 

By providing your payment details, you authorize us to charge your chosen payment method for the booking amount and for any additional amounts that may become due in connection with your booking. You represent and warrant that you are authorized to use the payment method and that sufficient funds or credit are available to complete the transaction. (Please note that some banks may charge a fee if sufficient funds are not available.)

We may verify your payment method by obtaining a pre-authorization, charging a nominal amount, or using other verification methods before processing the final payment.

Fraud

If you suspect any fraudulent activity or unauthorized use of your payment method, you must contact your payment provider immediately.

If, in our reasonable view, a booking or account shows signs of fraud, abuse, association with a government-sanctioned person or entity, or other suspicious or illegal activity, or if we are requested by competent authorities, third-party providers, or partners, we may request additional information or documentation from you to investigate.

If we reasonably conclude that a booking or account is connected to fraud, abuse, a government-sanctioned person or entity, or any other suspicious or illegal activity, we may take one or more of the following actions:

  • cancel any bookings associated with your name, email address, or account
  • close any related accounts
  • apply other measures or restrictions  
  • take legal action, including seeking to recover any losses incurred

Payment Failure 

If your payment fails or if we receive a request from the payment provider to reverse a payment that has already been charged, we may cancel your booking or/and take other measures. You will remain responsible for any amounts that are still due.

8. Cancellations and Changes 

When you make a booking, you accept the applicable policies and Supplier Terms. You will find each Travel Provider’s cancellation policy and other relevant terms (such as age requirements, deadlines, security or damage deposits, additional supplements for group bookings, extra beds, meals, pets, accepted cards, etc.) during the booking process, in the fine print, and in your confirmation email or ticket (if applicable).

You do not have an automatic right to cancel or change a booking unless permitted by the relevant Travel Provider under its Supplier Terms and policies (which are provided to you before you make a booking). Travel Providers may charge fees for cancelling (in full or in part) or changing a booking. If an administrative fee applies, it will be disclosed to you before you confirm the change or cancellation.

Some bookings can’t be cancelled for free, while others can only be cancelled for free before a deadline. Some Travel Providers do not permit cancellations or changes after a booking has been made. You agree to pay any applicable charges resulting from cancellations or changes. Please note that for changes, the price of your new arrangements will be based on the price available at the time the change is made.

If you book a Travel Experience by paying in advance (including all price components and/or a damage deposit, if applicable), the Travel Provider may cancel the booking without notice if they can’t collect the balance or other required amounts on or by the specified date. If they do cancel, any non-refundable payment you have made may only be refunded at the Travel Provider’s discretion. It is your responsibility to ensure that your payment goes ahead on time and other requirements are met post booking (your payment details are correct, sufficient funds are available etc).

If you believe or expect you may not arrive on time, please contact your Travel Provider to advise them of your expected arrival time. It is your responsibility to ensure you arrive on time. We are not responsible for any associated costs if you fail to do so (including cancellation or fees charged by the Travel Provider).

As the person making the booking, you are responsible for the actions and conduct (in relation to the Travel Experience) of everyone included in the group.

Unless otherwise stated, we generally do not charge our own fees to process or administer cancellations or changes arranged for you with Travel Suppliers. However, your bank may charge fees or credit your account with different amounts due to Currency, Conversion, and Issuer Fees.

You may also have (additional) rights under the Australian Consumer Law in certain circumstances.

Cancellation and Change Process 

You may request to cancel or change any aspect of a booking through our Platform, by contacting us directly, or in some cases by contacting the Travel Supplier, depending on the Travel Service. Cancellations and changes are subject to the Travel Supplier’s terms and policies, availability and may incur fees. Some bookings cannot be changed or cancelled. Some bookings are non-refundable.

If we processed your payment, not the Travel Supplier and you cancel or request to cancel a booking within the permitted period and terms, and are entitled to a full or partial refund, we will process your refund accordingly.

We or the Travel Providers may also cancel or change your booking for various reasons, including operational requirements, overbooking, system or allocation errors, connectivity issues, force majeure events, payment failure, carrier rescheduling, or obvious errors or misprints. If this occurs:

  • We will notify you when informed
  • Refunds and alternative options are subject to the Supplier Terms, availability and applicable policies 
  • We will make reasonable efforts to assist you but are not liable for any losses or costs that you may incur

No-show or Cancellation During the Travel Experience  

If you fail to show up for your booking, including the first day/night of it, or you leave your Travel Experience early or you are removed from the Travel Experience because of a breach, fraud, conduct or physical/mental/medical impairment or at the discretion of the Travel Experience Provider, you may forfeit the entire booking amount, any unused portions of it or subsequent bookings may be cancelled subject to the Supplier Terms and other applicable policies.

9. Refunds  

If applicable and eligible, refunds after any unrecoverable costs deducted will be issued to your original payment method, subject to the applicable policies and processing times, including those of the relevant Travel Suppliers. In relation to the refunds, your bank may charge fees or credit your account with different amounts subject to their Currency, Conversion and Issuer Fees. 

Subject to your rights under the Australian Consumer Law, as well as our and the relevant Travel Supplier’s Terms, applicable cancellation, change and refund policies, certain fees, charges, or payments may be non-refundable.

Refund processing times may vary, but we aim to process most refunds within 14 business days. We will inform you and, where possible, provide an estimated timeframe if we are awaiting receipt of refundable amounts from Travel Suppliers. We do not have visibility into a Travel Provider’s internal refund process.

Under certain circumstances, you may request — and we may, at our discretion, approve — Credit Notes to allow you to book another Travel Experience without waiting for the refund process to complete. Such credits come with their own terms and conditions in addition to these Terms. 

10. Your Responsibilities, Travel and Fitness 

Although most travel occurs without incident, travel to certain destinations or certain Travel Experiences may involve more risk than others. Travel Experiences are provided by Travel Suppliers and we are not guaranteeing that they are without risk – and, to the fullest extent permitted by law, we will not be liable for any resulting damages, injuries or losses.  Some Travel Providers may require you to sign their liability waiver prior to participating in the Travel Experience they offer.
Most airlines require customers to use their flights in order. So, if you don’t take your first Flight, your airline may automatically cancel the rest of your itinerary and you may not be entitled to a refund for the unused portions of your itinerary. Your airline may charge for checked baggage, excess/overweight baggage, priority boarding, allocated seating, onboard entertainment, food and drink and/or airport check-in. Some countries may require you to hold a return ticket as an entry requirement. 

We are not liable if you are refused entry onto a flight or a cruise ship (if applicable) or into any country, due to your conduct, including your failure to carry the correct and adequate travel documents required by any Travel Provider, authority or country (including countries you are transiting through). Any fines or penalties are your responsibility.

You are responsible for:

  • Providing accurate, complete information
  • Reading and complying with these Terms, Supplier Terms other applicable regulations 
  • Obtaining all necessary travel documents (passports, visas, permits, health certificates)
  • Meeting all entry, exit, and health requirements
  • Obtaining appropriate travel insurance
  • Checking travel advisories
  • Ensuring fitness to travel
  • Paying all amounts due
  • Complying with all applicable laws
  • Not using our Platform for unlawful purposes or fraudulent activity

In this regard, you are responsible for obtaining and carrying all required travel documents, including:

  • Valid passport (usually requiring at least 6 months validity from your return date)
  • All necessary visas (including for countries you transit through)
  • Health certificates and vaccination records
  • Any other documents required by authorities

Check requirements well in advance with the relevant authorities (embassies, consulates, visa services, official warnings or advice). Requirements can change at any time. We do not warrant the accuracy or suitability of any information provided by any external or Travel Experience provider and accept no liability for any loss or damage which you may suffer in reliance on it.

11. Travel Insurance 

Unless otherwise stated, prices displayed do not include travel insurance. You are advised that you purchase appropriate travel insurance covering, at minimum, trip cancellation, medical expenses, emergency evacuation, baggage loss, travel delays, and personal liability. 

You may be shown certain travel insurance products but you are responsible for ensuring that any insurance policy taken out adequately covers your requirements.

12. Liability 

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under the Australian Consumer Law or other applicable law.

We make no representations, warranties, or promises regarding the products or services of any Travel Provider beyond those expressly stated in these Terms. We own and operate our Platform and the Travel Suppliers provide the Travel Services to you.

If you are in breach of these Terms and/or the Travel Provider’s terms, we will not be liable for any costs, losses, or consequences you incur as a result.

For the avoidance of doubt, in the event of a third party provider being unable to provide you with the product or service or part thereof you have booked due to that third party provider becoming insolvent or being placed under external administration, subject to your refund and remedy rights under law, and except to the extent of recoverable amounts (for which we will use reasonable efforts to assist) we have no obligation to reimburse you for the cost of your booking or for any loss or damage you may otherwise suffer.

You may also be protected by mandatory consumer protection laws and regulations that grant you rights which cannot be excluded or overridden by any company’s terms.

This limitation of liability reflects the allocation of risk between you and us. The limitations specified in these Terms will continue to apply even if any limited remedy is found to have failed its essential purpose. The limitations of liability set out in these Terms shall inure to our benefit.

To the maximum extent permitted by law and subject to the exceptions and limitations in these Terms, we are not liable, directly or indirectly or in any other form, for:

(a) Travel Services

  • Any Travel Services provided by Travel Providers.
  • The acts, errors, omissions, representations, warranties, breaches, or negligence of any Travel Provider.
  • Personal injury, death, property damage, or other losses arising from Travel Services.
  • The quality, safety, availability, or suitability of Travel Services.
  • Any failure by Travel Providers to provide Travel Services.

(b) Information (as outlined in Our Platform and Using Our Service)

  • The accuracy, completeness, or currency of information provided by Travel Providers.
  • Errors, omissions, interruptions, or inaccuracies in such information.

(c) Third Parties

  • Insolvency or business failure of Travel Providers.
  • Acts or omissions of third parties.
  • Third-party websites, services, content, promises, or representations.

(d) Events Beyond Our Control

  • Force majeure events (including natural disasters, pandemics, epidemics, war, terrorism, or civil unrest).
  • Government actions, regulations, travel restrictions, or border closures.
  • Strikes, industrial action, adverse weather, technical problems, or transport disruptions.

(e) Your Actions

  • Errors or omissions in the information you provide.
  • Failure to obtain necessary travel documents or insurance.
  • Failure to comply with these Terms or any applicable requirements.

(f) Indirect Losses

  • Indirect, consequential, or special losses.
  • Loss of profits, savings, business, or enjoyment.
  • Losses not reasonably foreseeable or not arising from our wilful misconduct.

Platform

To the maximum extent permitted by law, we disclaim all warranties and conditions, express or implied, that:

  • Our Service, servers, or emails will be free from viruses or harmful components.
  • The materials or content on our Platform will be uninterrupted or error-free.
  • Any defects or omissions will be corrected.

Maximum Liability

Under circumstances where our liability cannot be excluded, to the maximum extent permitted by law, our total aggregate liability for any claim shall be limited to, and shall not exceed the amount you paid us in relation to the booking giving rise to the claim.

We will only be liable for direct losses that you actually suffer and that are directly caused by our breach, wilful misconduct, or negligence. Our liability may also be further limited by applicable international conventions.

You must take reasonable steps to manage your risks and mitigate any loss.

13. Intellectual Property 

All intellectual property rights in and to our Platform (including its content, design, software, and underlying technology) are owned by us or our licensors. You may not use, copy, modify, distribute, or otherwise exploit any part of our Platform without our prior written authorization.

If you submit, upload, or provide any content through our Platform (including reviews, comments, or feedback), you grant us a worldwide, perpetual, irrevocable, royalty-free, and transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in any media. You warrant that you own or otherwise control all rights in such content and that it does not infringe any third-party rights.

Our Service and all content and information available on or through it are protected by copyright, trademark, and other applicable intellectual property laws. To the maximum extent permitted by law, any reproduction, distribution, or modification of our Service or its content (in whole or in part), including the copying of text, graphics, or designs, is strictly prohibited.

14. Privacy Policy

We are committed to protecting the privacy, confidentiality, and security of the personal information you entrust to us, and to handling it with care. Our Privacy Policy explains how we collect, use, store, and protect your personal information. It forms part of these Terms.

To facilitate your bookings, you agree that we may, in certain circumstances, disclose your personal information to Travel Providers and other service providers, including recipients located overseas. Such recipients may include overseas travel service providers (for example, airlines, accommodation providers, or tour operators) with whom you make a booking.

Please note that these overseas recipients may not be subject to the same data protection laws as those in Australia. Generally, we will only disclose your personal information to such entities or persons where it is necessary to facilitate your booking or to enable them to perform Travel Services, and administrative or technical aspects of them.

For the purposes of this section, “disclose” includes transferring, sharing, sending, or otherwise making your personal information available to another person or entity.

If you have consented, we may send you marketing communications. You can opt out at any time by clicking the unsubscribe link in the communication or by contacting us directly.

Acknowledgment

By using our Platform or making a booking, you acknowledge that:

  1. You have read, understood, and agree to these Terms
  2. You have read the Travel Provider's terms applicable to your booking
  3. You understand your contract for Travel Services is with the Travel Provider
  4. You understand the limitations on our liability
  5. You are at least 18 years old with legal capacity to contract
  6. All information you provided is accurate and complete

If you do not accept these Terms, you must not use our Platform.
